Düsseldorf - 27.09.2016 - Criminal lawyer, Dr. Rademacher, - successful appeal against arrest warrant.
Allegded money laundering and fraud were cited in the arrest warrant issued by the Criminal Court of Düren, the same arrest warrant, which the Aachen Regional Court had confirmed initially.
On the basis of our appeal the Higher Regional Court of Cologne (OLG Cologne, ruling of 27.09.2016 - 2 Ws 632/16) quashed the arrest warrant against the businessman from the tourism industry.
The Higher Regional Court of Cologne - unlike the local and regional courts in the weeks prior – concurs with our argument that there is actually no risk of flight, no obscurity and no risk of a repeat offence and that several of the charges are questionable.
As a consequence, the public prosecutor's office in Aachen has to withdraw its extradition request to England, no extradition from England will occur and the European arrest warrant has been lifted.
