Duesseldorf / Germany - 15.06.2016 - Criminal lawyer Dr. Rademacher on the extradition to Poland on the basis of a European arrest warrant.
Our constitutional complaint was successful. By order of 15.06.2016 - 2 BvR 468/16 - the Federal Constitutional Court annulled the decision of the Higher Regional Court (Kammergericht) in Berlin, which had previously declared the extradition of our client to Poland admissible. The Federal Constitutional Court confirmed the breach of fundamental rights (Article 16 (2) German Basic Law).
We had anticipated this result after the Federal Constitutional Court had previously upheld our emergency application and thus stopped the imminent extradition to Poland.
